About these terms
These terms, including the community guidelines below, cover your use of the Summited app and this website. Summited is built and run by Michael Hutchinson, a sole developer based in the United Kingdom (we, us).
By downloading or using Summited you agree to these terms. If you do not agree, please do not use the app. Our privacy policy explains how we handle your data.
Who can use Summited
You must be 13 or over to create an account. If you are under 18, please check these terms with a parent or guardian before you sign up.
Your account
- Keep your sign-in details secure and do not share your account. You are responsible for what happens on it.
- Give accurate details, and do not pretend to be someone else or choose a handle meant to mislead.
- One person per account. Do not create accounts to get around a block, a suspension or a ban.
- You can delete your account at any time in the app, or by following the steps at summited.app/delete-account.
Community guidelines
Summited is for people who love the hills. Be kind, be honest, and share the kind of thing you would be happy to show anyone on the summit with you.
We have zero tolerance for objectionable content and abusive members. You must not post, send or tag anything that:
- Harasses, bullies, threatens or intimidates anyone.
- Is hateful or discriminatory, including on the grounds of race, ethnicity, religion, disability, sex, gender identity or sexual orientation.
- Is sexually explicit, or sexualises anyone under 18 in any way.
- Is violent or graphic, or encourages self-harm or harm to others.
- Is spam, advertising, scams, or misleading links.
- Impersonates another person or organisation.
- Shares someone else's personal information, or photos of people who have not agreed to be shared, without their permission.
- Infringes someone else's copyright or other rights, or that you do not have the right to share.
- Is illegal, or encourages illegal or dangerous activity, such as trespass or ignoring access restrictions.
Fair use
Do not misuse the app or our servers. That includes trying to get around privacy settings, blocks or rate limits, accessing data you are not allowed to see, scraping or automating the app, logging false summits to mislead others, or interfering with the service or other members.
Reporting and blocking
If you see something that breaks these guidelines, please report it. In the app you can report a member from the menu on their profile, report a comment from its menu (the three dots, or press and hold), and report a photo with Report photo when you open it. You can block a member from the menu on their profile or on one of their comments. Blocking hides your profiles and content from each other and removes any follow between you. You can see and undo blocks in Settings, Blocked accounts.
You can also email support@summited.app about anything that worries you, including a note, a companion tag or a notification.
How we act on reports
We review reports within 24 hours. If content breaks these terms, we will remove it, and we may suspend or permanently close the account that posted it, without notice where the breach is serious. We may also remove content or restrict accounts on our own initiative. Where the law requires it, we will pass information to the police or other authorities.
If you think we got a decision wrong, email support@summited.app and we will look at it again.
Your content
Your content is everything you add to Summited: your profile, avatar, rounds, notes, photos, comments, cheers and companion tags. You keep ownership of it.
You give us a non-exclusive, royalty-free, worldwide licence to store, copy, resize and display your content, only to run Summited and to show it to the people your privacy settings allow. This licence ends when you delete the content or your account, apart from copies in backups, which are deleted within 30 days, reports kept as moderation records as our privacy policy explains, and anything we must keep for a legal requirement.
Only share content you have the right to share. You are responsible for what you post.
Other services
Summited works with other services, such as Strava, Google and Apple for sign-in, maps and connecting your activities. Your use of them is covered by their own terms and privacy policies, and we are not responsible for them. Hill data comes from the Database of British and Irish Hills under the CC BY 4.0 licence.
Summited Pro
Some features may be offered as Summited Pro, an auto-renewing subscription sold through the App Store or Google Play. Prices and billing periods are shown in the app before you buy.
Your subscription is billed through your Apple or Google account and renews automatically at the end of each period unless you cancel at least 24 hours before it ends. You manage and cancel it in your App Store or Google Play subscription settings, not in Summited. Refunds are handled by Apple or Google under their policies. Deleting the app or your Summited account does not cancel the subscription.
Nothing in these terms affects your legal rights as a consumer.
Safety on the hill
Summited is a logbook, not a navigation or safety tool. Do not rely on it to find your way, judge conditions or decide whether it is safe to go.
- You are responsible for your own safety and for anyone in your care. Carry a map and compass and know how to use them, check the forecast, and turn back when conditions call for it.
- Summit positions, heights, names and list details come from third-party data and may contain errors.
- Weather forecasts come from Open-Meteo and may be wrong. Mountain weather changes quickly.
- Summit suggestions from Strava or GPX files are estimates and may be wrong.
- A summit appearing in the app does not mean there is a public right of way or open access to it. Follow the Countryside Code, or the Scottish Outdoor Access Code in Scotland.
The service
We work hard to keep Summited running and your data safe, but the app is provided as it is and as available. We may change, pause or stop features, and we cannot promise the app will always be available or free of errors. The logbook on your phone keeps working without a connection.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law of England and Wales.
Otherwise, as far as the law allows, we are not responsible for loss or damage that was not foreseeable, for any loss arising from your activities outdoors, or for business losses. Our total liability to you for anything to do with Summited is limited to the amount you paid us for Summited Pro in the 12 months before the claim, or 50 pounds if that is greater.
Ending your use
You can stop using Summited and delete your account at any time. We may suspend or close your account if you break these terms, if we have to by law, or if we stop providing the app. Where it is reasonable, we will tell you first.
Changes to these terms
We may update these terms as Summited grows. If a change matters, we will update this page and the effective date at the top, and the app will ask you to accept the updated terms the next time you open it. If you do not accept them, you can stop using Summited and delete your account.
Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
